Behavior Tickets

2 weeks ago, Josh came home with a behavior ticket, again.  It said that he wasn't obeying and following the teachers instructions.  I asked him what was going on.  He told me that he couldn't find his purple book and the teacher gave him a ticket for it.  "You mean the purple book you brought home the first week of school here?"
I show him the book and he nods his head.  When he had brought it home, it had no instructions with it and Josh said that his teacher didn't say he had to bring it back.  So, he didn't.  Evidently, they have been working on this 'purple' book every other day since Josh has been in school.  He never told the teacher that he didn't have it , hence the 'not following the teacher's instructions.'  My question though is how could she have NOT noticed that he didn't have his book?  She sends home these behavior sheets telling me how he's been doing and often times she'll have tick marks showing how many times she's asked him to turn around, or to stop talking, or to start his work.  With all this time that she's spending focusing on his behavior and marking her tick marks, why did it take her 4 1/2 months to notice that he didn't have his book? Also, what in the world has he been doing since he didn't have the book?  He must have figured something out because he'll come home with all 5's for the day meaning that he was practically perfect the whole day.  I completely disagree with this ticket but with only 3 weeks of school left, I didn't think it was worth fighting.

Yesterday he handed me another behavior ticket that said he did not obey the library substitute and that he was throwing things in the library.  I asked Josh what happened.  Here's his story.
"We were suppose to be lining up but Jaden's bandanna was on the floor and I picked it up.  But it was wet so I threw it."
"Why did you throw it?  Why didn't you just drop it back on the ground?"
"I don't know.  But I WASN'T trying to get the toy off the wall."
Nice Josh. 
This ticket means that he won't be able to go swimming with his class next Wednesday for their year end activity.  Luckily, Josh said he didn't want to go anyway.  Right.
